The TOU establishes that by using the ID platform (inclusiondirect.ca), candidates, families, and employers agree to these rules. ID provides access to product information, communication forums, and resources designed to facilitate your structured support and contingency model..
2. Professional Conduct & Accountability
To maintain a safe and “low-risk profile” for all participants:
- Lawful Use: Users must use the site for its intended mission. Harassment, stalking, or any conduct that restricts others from using the service is strictly prohibited.
- Account Security: Candidates and families are responsible for keeping their login credentials confidential. ID is not liable for unauthorized account access but may hold users responsible for losses caused by security breaches.
3. Communication & Support Services
ID provides “Communication Services” (forums, communities, etc.) to support the journey of work-ready graduates and residents.
- Safety First: Users must not share inappropriate content or personal information of others without consent.
- No Solicitation: To protect the integrity of ID’s placement model, users cannot use the platform to advertise outside services or “poach” candidates for competitive services.
4. Intellectual Property & Documentation
- Educational Use: Accredited institutions can download ID’s white papers or “FAQs” for classroom use, which aligns with supporting graduates. However, commercial redistribution requires written permission.
- Content Rights: If users post success stories or photographs, they grant ID the right to use that material to further the mission of inclusive hiring.
5. Risk Mitigation & Liability (The “Safety-Net”)
ID provides “Communication Services” (forums, communities, etc.) to support the journey of work-ready graduates and residents.
- “As Is” Basis: While ID strives for excellence in job coaching and placement, it provides information “as is” and does not guarantee uninterrupted website access.
- Liability Limits: ID is not responsible for the independent actions of users or third-party content. Users agree to indemnify ID against legal claims arising from their use of the platform.
6. Changes & Termination
ID reserves the right to update these terms or terminate a user’s account immediately if their conduct is deemed “unacceptable” or poses a risk to the community’s operational goals.
Section II: Safety, Ethics, and the Inclusion Direct Contingency Model
A. Commitment to Workplace Success
Inclusion Direct (ID) operates on a structured support and contingency model designed to meet the operational goals of our employer partners while fostering the professional growth of our Candidates (Work-Ready Graduates, Stabilized Residents, and Adaptive Candidates). Users acknowledge that the “Services” provided include ongoing coaching and a robust backup system intended to mitigate risk in inclusive hiring.
B. Ethical Conduct & Candidate Protection:
- Dignity and Respect: All Users (including Employers, Candidates, and Families) agree to interact in a manner that upholds the dignity of individuals with developmental disabilities.
- Privacy of Residents: Users must respect the privacy of “Stabilized Residents” and “Adaptive Candidates.” Sharing sensitive information regarding a candidate’s living situation, specific disability, or behavioral history outside of authorized ID communication channels is strictly prohibited.
- Professional Integrity: Employers agree to collaborate in good faith with ID’s job coaches and support staff to ensure the “safety-net” remains effective for both the business and the employee.
C. The “Safety-Net” Protocol:
- Risk Mitigation: While ID provides a contingency framework to ensure daily operational goals are met, the User acknowledges that this is a collaborative effort. ID is not liable for incidental workplace variances but remains committed to providing support through its coaching and backup systems.
- Intervention Rights: ID reserves the right to temporarily suspend or adjust a placement if it determines that the environment no longer meets the safety or stability profiles required for the Candidate’s success.
D. Non-Circumvention
To protect the integrity of the ID support system, employers and third parties agree not to independently solicit or hire ID Candidates outside of the structured ID platform without express written consent, as doing so removes the “risk-management” protections vital to our mission.
